Academic censorship in prison

The Ninth Circuit reversed a lower court's summary judgment favoring Washington prison officials who blocked an inmate's short story from reaching a university literary journal. Officials flagged the story, written as part of a prison writing program, for referencing sexual intimacy and refused to transmit it.

The appeals court found that, if the inmate's claims are proven at trial, the refusal amounted to censorship barred by the First Amendment.
