Few sentences have ever accused a sitting judge of opposing national Greatness and then shrugged ‘but who knows?’ before reaching a period, yet here one is. A judge’s job is to decide a case, not to want Greatness for anyone, and a parenthetical shrug does not turn an insinuation about pending litigation into a joke. The project is ‘completely nonviable’ and ‘unsafe’ until, a single sentence later, it becomes one of the Most Wonderful courses anywhere, apparently because the word ‘Plan’ was capitalized. We also learn that a federal department is ‘so proud’ it would be sad without a ruling in its favor, which is not how agencies, courts, or feelings are supposed to work.
